These Terms & Conditions ("Terms") govern your access to and use of the Dumb Brain Sports mobile application and related services (the "Service") operated by Dumb Brain Sports ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and that you are legally permitted to use the Service in your jurisdiction.

2. The Service

Dumb Brain Sports lets you and your groups make simulated picks against the spread, compete on leaderboards, chat, and earn the in-app $DUMBBRAIN token. The app may surface informational analysis and may link to independent third-party platforms (such as Kalshi) where you can choose to transact. We are not a sportsbook, broker, or financial advisor.

3. Accounts

• You are responsible for the accuracy of your account information and for keeping your credentials secure.
• You are responsible for all activity that occurs under your account.
• Notify us promptly of any unauthorized use at support@dumbbrainsports.io.

4. $DUMBBRAIN Token

• $DUMBBRAIN is an in-app token used for gameplay, feature unlocks, and community engagement.
• $DUMBBRAIN is provided "as is" for use within the ecosystem. We make no promise or guarantee regarding any monetary value, price, liquidity, or future utility of the token.
• Nothing in the Service constitutes financial, investment, legal, or tax advice. You are solely responsible for any decisions you make and for any applicable taxes.
• On-chain transactions are irreversible and occur on the Solana network. You are responsible for safeguarding access to your wallet and for any network fees.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Cheat, manipulate scoring or leaderboards, or use bots or automated means.
• Harass, abuse, or harm other users, including in group chat.
• Attempt to access accounts, data, or systems without authorization.
• Reverse engineer, disrupt, or interfere with the Service.

6. User Content

You retain ownership of content you submit (such as chat messages, usernames, group names, and images). You grant us a non-exclusive, worldwide, royalty-free license to host, display, and use that content as needed to operate the Service. You are responsible for the content you post and must have the rights to share it.

Zero tolerance for objectionable content and abusive behavior. By using the Service you agree not to post, upload, or transmit any content that is unlawful, harassing, abusive, threatening, hateful, defamatory, obscene, sexually explicit, or otherwise objectionable. This is a condition of your license to use the app (EULA).

To keep the community safe, we:

• Automatically filter objectionable language from chat messages, usernames, group names, and other user-submitted text.
• Let you flag or report objectionable content directly from the app.
• Let you block abusive users, which immediately removes their content from your feed and notifies us for review.
• Review reports of objectionable content and act within 24 hours by removing the content and ejecting users who post it.

There is no tolerance for objectionable content or abusive users. We may remove content and suspend or terminate accounts that violate these Terms, with or without notice.

7. Intellectual Property

The Service, including its design, logos, and software, is owned by Dumb Brain Sports and protected by intellectual property laws. You may not copy, modify, or distribute it except as permitted by these Terms.

8. Third-Party Services

The Service relies on and may link to third-party services (including odds data providers, our authentication and wallet providers, and platforms such as Kalshi). We are not responsible for the availability, content, or practices of third-party services, and your use of them is governed by their terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that picks, analysis, or any information will be accurate, profitable, or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUMB BRAIN SPORTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Dumb Brain Sports from any claims, damages, or expenses arising out of your use of the Service or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service and delete your account at any time.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
